MRT/AAT Appeal

One of the ways for appealing could be to appeal to the Migration Review Tribunal if you have been denied an Australian visa (MRT). (MRT). Where a visa has been denied, the MRT is empowered to re-evaluate the initial decision and to examine whether the applicant satisfies the visa criteria. In other words, If your visa application has been rejected and you wish to appeal against the decision, the MRT provides an opportunity to have that negative decision reviewed and, potentially, reversed.

There are however strict time limits in making an appeal and it is very important that as soon as you receive a letter advising you that your application for a visa is unsuccessful you should immediately contact us.

Applications are refused or visas are cancelled mainly because of the following reasons:

  • when one or more complex legal or factual issues are arised from the application which are decided against the applicant.
  • insufficient evidence is presented to the Department of Immigration;
  • the case wasn’t properly explained to the Department of immigration
  • the claims of the applicant were not believed, or
    a combination of all of these factors.

The Australian government has 2 tribunals to process appeals in terms of immigration purposes – the Refugee Review Tribunal (RRT) and the Migration Review Tribunal (MRT). Each of these two tribunal deal with different visa applications, and in which tribunal you have to lodge your appeal depends on the type of visa application you have made.

At the hearing, we will not only help in the presentation of your argument as to whether a rejection can be reversed, but we will also be able to assist with the original appeal, regarding on what grounds the modification of the visa refusal should be argued and on what documents the claimant should apply in order to inform the MRT member of the need to change the result of the visa refusal.

Eligibility criteria

person applying for review must be the visa applicant, the former visa holder, the sponsor or a close relative.
